THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. It is the contention of the petitioner that his grandfather late Gangappa S/o. Marappa had filed an application in the year 1961 seeking grant of 4 acres of land in Sy.No.130 of Vaddihalli Village, Kaiwara Hobli, Chinthamani Taluk, Chikkaballapura District and that there was recommendation at the hands of the Tahasildar to the Assistant Commissioner, Chikkaballapura Sub-Division, Chikkaballapura as can be seen at Annexure – C that all the three persons named therein were eligible for grant of four acres each in Sy.No.130. Learned High Court Government Pleader raises an objection that under the provisions of the Karnataka Land Grant Rules, the land can be granted to the petitioner only on the basis of the eligibility of the petitioner and not on the basis of the application filed by the petitioner’s grandfather in the year 1961. 4. Upholding the submissions of the learned High Court Government Pleader, writ petition stands disposed of reserving liberty to the petitioner to file a fresh application seeking grant of land along with the material placed before this Court. If such an application is filed, the competent authority shall consider the same and pass necessary orders as expeditiously as possible and at any rate within a period of three months from the date when the application is filed by the petitioner.
