The petitioner is before this Court seeking for the following reliefs; a. Appoint a sole arbitrator for the purpose of adjudication of the disputes between the Petitioner and the Respondents under the registered Agreement of Sale dated 15.06.2024 that was registered on 26.08.2024 before the office of the sub registrar, Mahadevpura, Bangalore, as per Arbitration clause at clause 14.17 of Annexure H, J, L. b. Pass such other Orders as this Hon'ble Court may deem fit and necessary in the above Civil Miscellaneous Petition in the above case in the interest of Justice and Equity. 2. After arguing for sometime, the learned counsel for the respondent submits that a suitable arbitrator could be appointed, leaving all contentions open to be decided by the said arbitrator. In that view of the matter, I pass the following: ORDER i) CMP is allowed. ii) Sri.Justice P.N.Desai, former judge of this Court is appointed as a sole Arbitrator to arbitrate the dispute between the parties under - 4 - HC-KAR NC: 2025:KHC:46768 CMP No. 437 of 2025 the aegis of the Arbitration Centre attached to this Court. iii) Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful. iv) Since the order is passed in the presence of all the counsel, they shall appear before the Director, Arbitration and Conciliation Centre without requirement of any notice on 03.12.2025 at 2.30 p.m. v) All contentions are left open. vi) Registry is directed to return the original and/or certified copies, if produced, to the respective parties who have produced it/them by following due procedure.
