On 02.02.2023, the petitioner submitted an explanation to the Tahsildar that the petitioner along with her husband, had been to America for two months from 09.10.2023 to 02.12.2023 to assist their pregnant daughter. Later, the 3^^ respondent considered the representation and granted two months leave. During this period. Village Revenue Assistant distributed the commodities to avoid inconvenience. The petitioner approached the 2"^ respondent on 02.12.2023 to restore the dealership, however, no action has been taken. Hence, this writ petition was filed. 2. The learned counsel for the petitioner submitted that without any disciplinary action taken, the supply of the commodities cannot be stopped. 3. 3 N Z*' BSB,J W.P.No.4637of2025 The learned Assistant Government Pleader submitted that the petitioner is entitled to leave for a period of two months only on the ground of ill-health and if the leave period is more than two months, the vacancy shall be filled by issuing notification as per clause XII (x) of the G.O.Ms.No.32 CA, FC &S, dated 03.12.2018, treating it as resignation. He further submitted that the letter said to have been given for restoration of the dealership was addressed to the Tahsildar who is incompetent, being not the appointing authority. 4. The learned counsel for the petitioner submitted that an opportunity may be given to the petitioner to submit a fresh representation to the appointing authority ie., the Revenue Divisional Officer. 5. In view of the above facts and circumstances, the writ petition is disposed of giving liberty to the writ petitioner to submit a fresh representation within one month from receipt of the copy of this order to the appropriate authority who shall dispose of the same within one month thereafter as per law. There shall be no orders as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed. 6. Sd/- K.
