THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner, an Institutional Member with the third respondent, has called in question the fixtures announced by the third respondent for the conduct of 'Maharaja Cricket League T20 Tournament' and for certain directions to the third respondent to produce the documents. Sri Deviprasad Shetty, the learned counsel for the petitioner, canvasses the following to support the petitioner's prayer. (i) The contract to host the Event is entrusted to a contractor whose contract has expired long back. (ii) Contrary to the Bye-laws, the third respondent has permitted a Head Coach - 4 - HC-KAR NC: 2025:KHC:32158 WP No. 24460 of 2025 to own a team that is participating in the tournament, and (iii) the conduct of the Tournament is not approved by the General Body. As against these assertions, Sri B K Sampath Kumar, the learned Senior Counsel for the third respondent, seeking leave to place on record certain documents, submits that the tournament is not being held at Chinnaswamy Stadium, but it is being held in Mysuru; that the petitioner has already approached the Registrar of Societies under Section 25 of the Karnataka Societies Registration Act, 1960 and a hearing is scheduled. The learned Senior Counsel refutes the assertions that are canvassed in support of the request. This Court must opine that the grounds urged, including the refusal to furnish certain documents, are matters that could be flagged within the institution by a member according to the Bye-laws. - 5 - HC-KAR NC: 2025:KHC:32158 WP No. 24460 of 2025 Crucially, if there is any reason for judicial intervention with the ongoing affairs, it must be in a properly instituted suit unless exceptional circumstances are made out. This Court, in the light of the afore and the fact that the fixtures are underway, is not inclined to interfere and the petition stands disposed of subject to all just exceptions in law.
