THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondents No.1 and 2. Notice to respondents No.3 and 4 is not necessary for the following reasons: - 3 - HC-KAR NC: 2025:KHC:31844 WP No. 23705 of 2025 2. The petitioners are seeking mutation entry of their names in the RTC after the lands have been acquired for the benefit of the Bangalore Development Authority. Although, it is the claim of the petitioners that their mother Smt. Govindamma had a share in the property and after her demise the share of the mother has now devolved on the petitioners, nevertheless when it is an admitted fact that the lands have been acquired for the benefit of the Bangalore Development Authority, at this juncture question of changing the mutation entries in the revenue records will not arise. If the petitioners are entitled for a share in the property and consequently a part of the compensation, they are required to file an application for apportionment of the award that has been passed in favour of the kathedar. 3. With these observations, the writ petition stands disposed of. - 4 - HC-KAR NC: 2025:KHC:31844 WP No. 23705 of 2025 4. Learned Additional Government Advocate is permitted to file his memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE KLY CT: JL
