CITY CIVIL AND SESSION JUDGE (CCH-54), BANGALORE AS AGAINST THE PETITIONER HEREIN WHO HAS BEEN ARRAYED AS ACCUSED FOR THE ALLEGED OFFENCE P/U/S 376,504 AND 506 OF IPC (ANNEXURE-F).

This petition is filed by the accused seeking quashing of the proceedings pending in S.C.No.895/2024 for the offences punishable under Sections 376, 504 and 506 of IPC.
2. Today, the victim is present before this Court and has placed on record an affidavit. On being specifically queried by this Court, she admits that she was in a consensual relationship with the petitioner and, in haste, had lodged the First Information Report against him. In paragraph 5 of her affidavit, she has further stated that she now wishes to put the past behind her, move forward in life, and lead a peaceful existence. She has, therefore, expressed her unequivocal intention to withdraw all the allegations made against the petitioner while lodging the complaint.

3. This Court has also made an enquiry regarding the personal status of the victim. She has submitted that she is a B.Com graduate and is presently employed with Flipkart.
4. The material on record discloses that the petitioner is an Engineer, while the complainant is a B.Com graduate. Both are adults and had voluntarily entered into a consensual relationship. The victim has, of her own volition, chosen to withdraw the allegations levelled against the petitioner. Taking into consideration the nature of the dispute, the stand taken by the victim, and the principles laid down by the Hon’ble Supreme Court in similar circumstances, this Court is of the considered opinion that no fruitful purpose would be served by continuing the criminal proceedings in S.C. No.895/2024. It is, therefore, a fit case to put an end to the prosecution so as to secure the ends of justice.
5. In the light of the foregoing discussion, the following order is passed:
ORDER i) The petition is allowed. ii) The proceedings in S.C.No.895/2024 pending on the file of the LIII Additional City Civil and
