Neutral Citation No. - 2025:AHC:132552 Court No. - 5 Case :- WRIT - A No. - 11114 of 2025 Petitioner :- Satyanarayan Upadhyay And 9 Others Respondent :- State Of U.P. And 17 Others Counsel for Petitioner :- P.K. Upadhyay Counsel for Respondent :- Abhishek Srivastava,Adarsh Bhushan,C.S.C.,Devesh Vikram,P.K. Upadhyay,Shivam Yadav Hon'ble Saurabh Shyam Shamshery,J.
1. Petitioners are aggrieved by communication dated 03.07.2025 whereby it was directed that in case employees have not made attendance even for a single day in June, 2025 in biometric through Urja Janshakti App, their respective salary for said month will be stopped.
2. Sri P.K. Upadhyay, learned counsel for petitioners has not disputed that petitioners have not made attendance for month of June, 2025 on said app and has referred that there may be internet problem since petitioners are usually on field duty.
3. S/Sri Shivam Yadav, Abhishek Srivastava and Devesh Vikram, learned counsel for respondents submit that this system was enforced by a notification dated 23.09.2024 which is not under challenge. So far as grievance of petitioners, learned counsel for respondents submit that none of petitioners has come forward to convey that there was internet problem.
4. I have considered above submissions.
5. Grievance of petitioner being vague is unsustainable since they have never approached concerned respondents during month of June, 2025 that due to internet problem, they were not able to mark biometric
attendance.
6. In aforesaid circumstances, Court is of the opinion that in case there is a genuine problem with petitioners about internet connection, they may individually approach the concerned respondents or they may submit proof that they have attended duties at concerned power station on said dates duly verified by senior officer working at power station.
7. In case petitioners are able to show that they have worked in June, 2025, their salary, if stopped, shall be released.
8. However, this order will not be considered that petitioner are exempted from making attendance by biometric through app.
9. Writ petition stands disposed of with above observations. Order Date :- 6.8.2025 N. Sinha Digitally signed by :- NIRMAL SINHA High Court of Judicature at Allahabad
