Heard Mr. P J. Barman, learned counsel for the applicant. I have also heard Mr. P. Thakuria, learned counsel for the respondent nos. 1 & 2. This is an application filed under Section 5 of the Limitation Act for condoning the delay of 42 days in preferring the connected appeal. The ground for delay in not filing the appeal in time has been explained in paragraph 2, 3, 4, 5, 6 & 7 of the delay condonation petition. Upon hearing the party, the learned counsel for the petitioner and on perusal of
Page No.# 3/3 the averment made in the above paragraphs, this Court is of the view that the applicant was prevented by sufficient cause on not preferring the connected appeal within time. The learned counsel for the respondent/claimant has also no objection for condoning the delay. In view of the above, the delay of 42 days in filing the connected appeal is hereby condoned. With the above, this I.A stands disposed of. The Registry shall register the connected appeal and list the same for admission by showing Mr. P.
