Kuldeep Singh ... Petitioner
Versus State of Punjab ... Respondent
CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA Present: Mr. Sahil Goel, Advocate, for the petitioner (through VC). Mr. Vivek Sharma, AAG, Punjab, for the respondent-State. *** MANISHA BATRA

1. The present petition has been filed by the petitioner under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short
“BNSS”) seeking regular bail in the FIR mentioned below:- FIR No. Dated Police Station Sections 38 19.04.2023 Fatehgarh Sahib, District Fatehgarh Sahib 307, 326 and 34 of IPC
2.
Brief facts relevant for the purpose of disposal of this petition are that the aforementioned FIR was registered on the basis of statement recorded by the complainant Balvir Kaur alleging therein that the petitioner and co-accused Jasvir Singh had become acquainted with her son Dharampreet Singh about 7-8 months back. They had become friends and sometimes used to visit her house. They had also taken her MANJU 2025.08.01 11:02 I attest to the accuracy and authenticity of this order /judgment Chandigarh

During the course of conversations, they had told the complainant that there was some religious place (chowki) in their village and anybody suffering from physical problems could be cured therein. She alleged that on 18.04.2023, the accused Jasvir Singh called her and intimated that the chowki was to be set up in their village on that day and she could come. On his asking, she agreed. The petitioner and the co-accused came to pick up her in a motorbike. They took her with them. They stopped the vehicle at a secluded place at the bank of the canal. The petitioner then picked up an iron rod and opened an attack upon her with an intent to kill her. She tried to save herself but sustained several injuries at their hands. Then while considering her to be dead, they fled away. She had fainted and regained consciousness only in the next morning. She raised alarm on hearing which, some persons reached there and took her to hospital. After registration of FIR, investigation proceedings were initiated. The petitioner was arrested and is in custody since 23.04.2023. Investigation now stands completed and the petitioner is facing trial for commission of the aforementioned offences. 3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. He is in custody since long. There are also no chances of his absconding as he has a permanent abode. His further incarceration would not serve any useful purpose. Therefore, it is urged that he deserves to be released on bail. 4.
Per contra, learned Assistant Advocate General, Punjab has submitted that there are serious and specific allegations against the petitioner MANJU 2025.08.01 11:02 I attest to the accuracy and authenticity of this order /judgment Chandigarh
CRM-M No.38713 of 2025 -3- as he caused serious injuries to the victim with an intent to kill her. It is argued that keeping in view the gravity of the allegations, the petitioner does not deserve to be released on bail. 5. This Court has considered the rival submissions. 6. The petitioner along with the co-accused is alleged to have assaulted the victim with an intent to commit her murder and is further alleged to have caused serious injuries on her person. The petitioner is in custody for a period of more than two years and three months. The trial would take time to conclude. The complainant has been examined in chief and partly cross-examined. The petitioner does not have any criminal antecedents. Taking all these facts into consideration, this Court is of the opinion that a case for release of the petitioner on bail is made out. Accordingly, the petition is allowed and the petitioner is ordered to be admitted to bail subject to his furnishing personal bonds as well as surety bonds to the extent of two sureties to the satisfaction of learned trial Court concerned and further subject to the condition that during the course of trial, he will not extend any threat to the complainant and will also not make any inducement or promise to her. He will not try to contact her and will conduct complete cross-examination of the complainant on the very first date when she appears for that purpose.
He will also disclose his present as well as permanent address before the learned trial Court at the time of furnishing of bonds and shall also give copy of his Aadhar Card, PAN Card if any and details of his mobile phone number(s) to the learned trial Court and in case, any change in his address or mobile phone number takes place, then he shall MANJU 2025.08.01 11:02 I attest to the accuracy and authenticity of this order /judgment Chandigarh
