Court No. - 76 Case :- HABEAS CORPUS WRIT PETITION No. - 35 of 2025 Petitioner :- Neha And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Farida Jamal,Syed Shahnawaz Shah Counsel for Respondent :- Priyavrat Tripathi, Ram Adhar Yadav, Satendra Kumar,G.A. Hon'ble Vinod Diwakar,J.
1. Heard learned counsel for the petitioners, the learned A.G.A. for the State, and perused the material available on record.
2. In compliance with the directions of this Court, both petitioners have appeared in person. Upon interaction with them, it is evident that they are residing together voluntarily and as per their own free will. It has been stated by the petitioners that they have solemnized their marriage at Shiv Mandir, Patna, on 28.03.2025. However, petitioner no. 2 has also asserted that they have performed a Nikah ceremony in Bihar.
3. The contradictory nature of the statements made by the petitioners, coupled with the absence of any conclusive documentary evidence in support of their claims, renders the pleadings vague and unsubstantiated.
4. Upon a careful evaluation of the facts and circumstances, it is clear that the present petition does not disclose a case of illegal or unlawful detention, as is required for invoking the extraordinary writ jurisdiction of this Court under Article 226 of the Constitution of India, particularly in the nature of a writ of habeas corpus.
5. Accordingly, this Court finds no ground to exercise its extraordinary jurisdiction. The writ petition is, therefore, dismissed. Order Date :- 30.4.2025 Anil K. Sharma Vinod Diwakar, J. Digitally signed by :- ANIL KUMAR SHARMA High Court of Judicature at Allahabad
