JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred under Section 483 of BNSS, 2023, to enlarge the petitioners on bail in Cr.No.141/2025 of Bannur Police Station, Mysuru District, registered for the offence punishable under Section 189(2), 189(4), 191(2), 191(3), 109 and 190 of BNS, 2023 2. In the complaint lodged by one Adarsha @ Adi S/o Madegowda, it is alleged that on 29.6.2025 at about 8.45 p.m., when he was talking to one Mahesh, in front of - 3 - HC-KAR NC: 2025:KHC:34642 CRL.P No. 11900 of 2025 his shop in Hunuganahalli village, about 12-15 persons came in 5-6 motorcycles holding longs and knives and they chased and assaulted him with the weapons they were carrying with an intention to commit his murder. 3. FIR is registered against one Kartik @ Kaaru, Shrinivasa and 15 others. Petitioners are not specifically named in the FIR. It is alleged that, on account of previous enmity, all the accused have assaulted the first informant, with an intention to commit his murder. In the remand application, petitioners are named as accused Nos.3 to 5 respectively. They are arrested on 4.7.2025. It appears that on the statement of the accused named in the FIR, petitioners are arraigned as accused in the remand application. Even though it is alleged that all the accused have assaulted the first informant with knives and longs, no life threatening injuries are sustained by him. As per wound certificate, he has sustained (i) one lacerated wound over the left side of lower chest 2 cm anterior and posterior aspect of chest (ii) abrasion over left side of - 4 - HC-KAR NC: 2025:KHC:34642 CRL.P No. 11900 of 2025 forehead. The injuries are mentioned as grievous in nature. The specific overt acts of assaulting the complainant is attributed against accused Nos.1 and 2. No weapons are recovered from the petitioners, after their arrest. Petitioners have no criminal antecedents. Hence, the following: ORDER I. Petition is allowed. II. Petitioners/accused Nos.3 to *5 in Crime No.141/2025 of Bannur Police Station, Mysuru District, shall be enlarged on bail, subject to following conditions: 1. They shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each, with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. They shall furnish proof of their residential address and shall inform the Court, if there is change in the address. * Corrected vide Chamber Order dated 12.9.2025. - 5 - HC-KAR NC: 2025:KHC:34642 CRL.P No. 11900 of 2025 3. They shall not directly or indirectly tamper with the prosecution witnesses. 4. They shall not indulge themselves in committing any offence. 5. They shall appear before the trial Court regularly on all dates of hearing. Violation of any of the condition shall result in cancellation of bail.
