1. Heard counsel for the parties. 2. The petitioner-firm alleges that during Covid-19 pandemic, the Department of Medical Health and Family Welfare, U.P., invited tenders for hiring cabs and taxis to conduct various programmes and operations relating to National Health Mission at district and block levels. The contract was settled in favour of the petitioner- firm and thereunder it provided ten cabs and sixteen taxis to the Department between 08.04.2021 upto 06.04.2023. However, payment of three bills of Rs. 19,50,000/- has not been made so far. It is submitted that the said amount is admitted to be due, but its payment is not being made on account of non-availability of funds. In support of the said submission, learned counsel for the petitioner-firm has invited our attention towards a communication dated 20.3.2024 by Chief Medical Officer, Etawah, addressed to the Director General of Medical Health and Family Welfare, U.P., Lucknow, in which request has been made to allocate necessary funds for payment of dues of the petitioner-firm. The prayer made in the instant petition is for a direction to the respondents to release the payment and take decision on the representation of the petitioner-firm dated 19.4.2025 made in this behalf. 3. Learned counsel for the petitioner-firm submits that the respondent be directed to take appropriate decision on the
representation of the petitioner-firm dated 19.4.2025. 4. Sri Rajiv Gupta, learned Additional Chief Standing Counsel, points out that the representation is addressed to respondent no. 3 and he submits that the petitioner should approach respondent no. 2 who alone would be competent for getting the requisite amount sanctioned. 5. Having regard to the submission made, we dispose of the instant petition with liberty to the petitioner-firm to make fresh representation along with true attested copy of the instant order before respondent no. 2 within two weeks from today and in which event, he will ensure that the amount due and payable to the petitioner-firm is paid to it along with reasonable interest within six weeks thereafter.
