This criminal miscellaneous petition has been filed under Section 482 of Cr.P.C for modification of the order dated 16.01.2024 passed in Cr. Appeal (DB) No. 1495 of 2022 by this Court whereby and whereunder the petitioner, namely, Md. Iqbal Hassan has been directed to surrender before the learned Court concerned within 10 days and on his surrender, he shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each, to the satisfaction of the Court concerned. 2. The reason for modification of the said order has been shown to be there in the instant petition that due to ailment of his wife, the petitioner could not surrender before the Court concerned, i.e., the Court of the learned Chief Judicial Magistrate, Sahibganj in connection with Borio (J) PS Case No.57 of 2022. 3. This Court has considered the reason shown in the instant petition and is of the view that the period of surrender of the petitioner before the Court concerned needs to be extended for the reason assigned therein. 4. Accordingly, the order dated 16.01.2024 passed in Cr. Appeal (DB) No.1495 of 2022 is modified to the extent that the petitioner, namely, Md. Iqbal Hassan shall surrender before the Court concerned within ten days from the date of receipt of a copy of this order and on his surrender, he shall be released on bail on the terms as specified in the order dated 16.01.2024. 2 5.
