Mr. Kushal Kumar, SPC with Mr. Suryansh Gaur, Advs for R-2. Mr. Prabhsahay Kaur, Standing Counsel DDA with Mr. Bir Inder Singh, Advocates for R-3/DDA. CORAM: HON'BLE MR. JUSTICE ANISH DAYAL O R D E R % 04.04.2025 CM APPL. 19880/2025 (CM For Restoration) 1. This application has been filed seeking revival of the contempt proceedings, which were disposed of by order dated 10th February 2025, on the submission of counsel for Municipal Corporation of Delhi (‘MCD’), that partial demolition had taken place on 06th February 2025, and further action was contemplated for 17th February 2025. 2. Counsel for MCD appears on advance notice, and states that action could not be taken on 17th February 2025, and is now fixed for 09th April 2025. This is a digitally signed order. The matter is being listed for ‘compliance’ on 17th April 2025. 4. Before the next date of hearing, a status report shall be filed along with photographs of demolition carried out, failing which, the concerned Officer of the MCD shall be present in Court. 5. It is noted that even on 28th January 2025, a statement was made by MCD that demolition action was stipulated on 03rd February 2025. It seems prima facie that there is a deliberate attempt to avoid taking action against the said unauthorised construction. The matter shall be considered on the next date. 6. Order be uploaded on the website of this Court. ANISH DAYAL, J APRIL 4, 2025/RK/tk Click here to check corrigendum, if any This is a digitally signed order.
