Neutral Citation No. - 2025:AHC:141272-DB Court No. - 3 Case :- WRIT - C No. - 25568 of 2025 Petitioner :- Chandrakanta Respondent :- Ms Icici Lombard General Insurance Co. And 3 Others Counsel for Petitioner :- Ashok Kumar Dwivedi,Ramesh Kumar Sahu Counsel for Respondent :- Aditya Singh Parihar Hon'ble Shekhar B. Saraf,J. Hon'ble Praveen Kumar Giri,J. 1.Heard learned counsel for the parties. 2. By means of the present writ petition, petitioner seeks the following relief: "(i) issue writ, order or direction in the nature of mandamus directing the ICICI Lombard to release insured amount for repayment of the home loan and also issue no dues certificate in respect of the house loan given to the petitioner's husband." 3. The petitioner is aggrieved by certain private parties. The petitioner complains that the respondent no. 1 has neither provided No Dues Certificate (NOC) in respect of the house loan given to the petitioner's husband nor released the insured amount. 4. Upon a perusal of the documents and upon hearing the submissions of the learned counsel appearing on behalf of the respondent no. 1, it is clear that the petitioner has filed a complaint before the Agra District Consumer Forum (First) bearing Complaint No. 27 of 2025. The other respondents in this writ petition are also private parties. 5. In our view, the writ petition is not maintainable. In any case, since the petitioner has already filed a consumer complaint she is required to pursue the same and not try to sail on two boats at the same time. 6. With the above observation, the writ petition is disposed of with liberty granted to the petitioner to approach the Consumer Forum for expeditious hearing of the complaint filed by the petitioner.
