The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent Nos. 1 to 4 to immediately release compensation along with interest with respect to acquisition of her land. 2. Learned counsel for the petitioner submits that respondent is utilizing petitioner’s 1 Kanal 15 Marlas land situated in Village Jhunghian, Hadbast 285, Tehsil Nawanshahar, District Shaheed Bhagat Singh Nagar without acquisition. The respondent is liable to pay compensation as per order dated 19.01.2017 passed by this Court in CWP-6275-2015. Learned State counsel submits that as per record, land was acquired in 1969. The respondent has carried out survey and found that as per site plan, petitioner’s 0 Kanal 0 Marla 2.4 Srs. land has been used by PWD. The averment of petitioner that respondent is using her 1 Kanal 15 Marla land is incorrect. 4. The afore-stated submissions disclose that disputed questions are involved and this Court cannot ascertain whether respondent is using petitioner’s land without acquisitioned or not. This Court can ask respondent to make payment if it is established that there is utilization of land without acquisition. 5. Disposed of. 6.
