This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 4(1A)/21 of MMDR Act and Rules 9/13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 pending in the court of C.J.M, Dhanbad in connection with Complaint Case No. 8260 of 2023.
3. The allegation against the petitioner who happens to be the BCCL employee is that the transport challan were issued after the dispatch of the same and post issuance of the railway receipts.
4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
5. Considering the fact that cognizance has already been taken, I direct the petitioner to appear before the court concerned and file his bail bond as there is no scope of investigation in this case.
6. Accordingly, this Anticipatory Bail Application stands
disposed of.
