Since common questions of law and fact are involved in these petitions, therefore they are heard together and are being decided by a common judgment. However, for the sake of brevity, facts of WPSS No. 869 of 2023 alone are being considered and discussed. 2. Petitioner had challenged transfer order dated 10.06.2023, whereby he was transferred from Government Ayurvedic Hospital, Dhatmer, District Uttarkashi to Allopathic Hospital Maldhanchaur, Nainital, District Nainital. 3. Learned counsel for petitioner submits that now someone else has been posted at Maldhanchaur, Nainital and petitioner is still continuing at Dhatmer, Uttarkashi. 4. Since the place where petitioner was transferred by impugned order has been filled by transferring someone else, therefore, this Court finds substance in the submission made by learned counsel for the petitioner that the 2025:UHC:8311 writ petition has become infructuous. 5. In view of the aforesaid facts, the writ petition is dismissed as infructuous; however, it shall be open to competent authority to pass fresh order of transfer in respect of the petitioner, as per law. 6.
