The complainants have filed the present complaint alleging willful disobedience of the order dated 25.11.2024 passed by the learned Single Judge of this Court in Writ Petition No.31291/2024 (GM-RES). 2. The complainants had filed the said petition alleging inaction on the part of the accused for enforcing the recovery certificate - 3 - HC-KAR NC: 2025:KHC:54545-DB CCC No. 335 of 2025 issued in their favour by the Karnataka Real Estate Regulatory Authority [RERA]. The recovery certificate has been issued pursuant to the proceedings in the complaint filed by the complainants before the said authority. 3. The learned AGA appearing for the accused has handed over a memo enclosing therewith confiscation order dated 25.09.2025, whereby certain properties of the defaulter had been confiscated. The said order also indicates that if the defaulter does not clear the amount as set out in the recovery certificate, public auction process will be conducted under Section 169 of the Karnataka Land Revenue Act, 1964 in respect to the properties confiscated in terms of the confiscation order. 4. In view of the above, the accused has taken steps for enforcing the recovery certificate. Therefore, we do not consider it apposite to initiate any proceedings for willful disobedience of the orders passed by this Court, at this stage. 5. The complainants are at liberty to apply afresh in the event, the recovery proceedings are not completed within a reasonable time.
