Heard the parties.
The petitioner has been made accused in connection with Tin Pahar P.S. Case No. 49 of 2023, for the offence registered under Sections 25(1- B)a, 26 and 35 of the Arms Act, pending in the court of learned Sub Divisional Judicial Magistrate at Rajmahal.
On 10.08.2023, Tinpahar Police apprehended the co-accused persons and on search, firearms were recovered from their possession.
It was submitted that name of the petitioner has transpired on the basis of confession of apprehended co-accused persons. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner.
Learned A.P.P on behalf of the State has opposed the prayer for bail and has submitted that petitioner has got criminal antecedents.
Considering the fact that there is no cogent material against the petitioner on record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate at Rajmahal, in connection with Tin Pahar P.S. Case No. 49 of 2023.
