The short point of controversy involved, in the cases at hand, is that the petitioners were regularized on completion of 10 years of service. However, on regularization benefits were extended to the petitioners on notional basis and not on actual basis.

By way of the present petitions, benefits are being claimed by the petitioners on actual basis. In this respect, petitioners have drawn attention of this Court to the judgment passed in CWP No.1893 of 2021, titled Arun Kumar Vs. State of HP & Ors., decided on 27.04.2023. Learned Addl. Advocate General also agrees that the cases at hand are squarely covered by the aforesaid
judgment.

For reasons alike, as have been mentioned in Arun Kumar’s case supra, the present petitions are allowed. Respondents are directed to treat the petitioners, as having been regularized on actual basis with effect from dates of their regularization. All consequential benefits flowing from their actual date of regularization be worked out and released in their favour within eight weeks’ from today. In view thereof, the present petitions are allowed. Pending miscellaneous applications, if any, are disposed of.
