JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs: “(a) Quash the entire proceedings pursuant to the Final Report/Charge Sheet in CC. No.2793/2024 filed by the Pulikeshinagar Police against the petitioners pursuant to Crime No.27/2018 for the offence punishable under Section 406, 420, 120B read with Section 34 of Indian Penal Code on the file of the 4th ACMM filed by the first respondent Pulikeshinagar Police; (b) Grant such other relief/s as this Hon'ble Court deems fit under the circumstances of the case in the interest of justice.” 2. Learned counsel for the petitioner – accused No.1 and learned counsel for 2nd respondent – complainant have filed a Joint Memo duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner – accused No.1, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Memo, which reads as under:- - 3 - HC-KAR NC: 2025:KHC:27059 CRL.P No. 5752 of 2025 “MEMORANDUM OF JOINT PETITION FILED UNDER SECTION 482 OF CODE OF CRIMINAL PROCEDURE. 1973 / UNDER SECTION 528 of BNSS Act. The Petitioner No.1 and The Respondent No.2/Complainant jointly submit as follows; 1. It is submitted that, the Petitioner herein are the Accused No.1 in a FIR registered by the Pulikeshinagar Police Station in Crime No.27/2018 for the offences punishable under Sections 406, 420, 12B Read With section 34 of the IPC. 2. It is submitted that, the grievance of the Complainant was that, the Accused No.1 is the co-signatory of church cheque was having purchase church construction materials. 3. It is further submitted that the petitioner is priest in the church and the respondent No.2 is the member of the church In recent past the church has formed new community members and office bearer with intervention with new office bearers the matter has been settled amicably further advised the Respondent No.2 to compromise the criminal petition. 4. The petitioner is only the signing authority who has nothing to do with the accounts secretary and treasures are the persons in charge of the accounts and purchases. 5. It is further submitted that the respondent No.2 has no objection in quashing the proceedings as against the petitioner. WHEREFORE, it is prayed that this Hon'ble court be pleased to record the joint memo and dispose off the matter by quashing the proceedings in Cr. 27/2018 on the file of 1st - 4 - HC-KAR NC: 2025:KHC:27059 CRL.P No. 5752 of 2025 Respondent in CC 2793/2024 pending on 4th ACMM B'lore as against the petitioner in the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) Petition is disposed of in terms of the Joint Memo dated 18.07.2025. (ii) The proceedings in C.C.No.2793/2021 (arising out of Crime No.27/2018 of 1st respondent – Police) registered for the offences punishable under Sections 406, 420 and 120B r/w Section 34 of IPC pending on the file of 4th Addl. CMM, Mayohall, Bengaluru insofar as the petitioner is concerned are hereby quashed. Sd/- (S.R.KRISHNA KUMAR) JUDGE Srl.
