JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2025:KHC:45103 WP No. 25878 of 2025 ORAL ORDER The present writ petition is filed seeking the following prayer: "PRAYER The Petitioners therefore respectfully pray that this Hon'ble Court may be pleased to: a) Issue a Writ of Certiorari or any other appropriate writ, order, or direction to quash the entire proceedings initiated by the Respondent No. 1 under Section 14 of the SARFAESI Act, 2002, in Crl.Misc.No.69/2025, on the file of the Senior Civil Judge, Chikkaballapur (Annexure-A). b) Pass any other order deemed just and proper in the facts and circumstances of the case, in the interest of justice and equity." 2. When the matter came up, learned counsel appearing of the respondent submits that on 06.11.2025, the matter is settled at Rs.6 lakhs and they have paid the entire amount. It is submitted that in the light of the same, the writ petition may be allowed. It is submitted that the original documents are lying with the Magistrate. 3. Considering the settlement dated 06.11.2025 and the submission that the entire amount is paid, this Court is passing the following: - 4 - HC-KAR NC: 2025:KHC:45103 WP No. 25878 of 2025 ORDER i. The entire proceedings initiated by Respondent No.1 under Section 14 of the SARFAESI Act, 2002, in Crl.Misc.No.69/2025, on the file of the Senior Civil Judge, Chikkaballapur are set aside. ii. Accordingly, the writ petition is allowed. iii. The Magistrate is directed to return the original documents to the respondent. iv.
