Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the
judgment passed by the Coordinate Bench of this Court dated 21.12.2022 in CWPOA No. 6997 of 2020, titled as, Dr. Shekhar Sharma vs. State of H.P. & others. He submits that the issue in both the cases are identical and since the judgment in CWPOA No. 6997 of 2020 has been

implemented by the respondents, a direction be issued to respondent No.2 to consider and decide the case of the petitioner in light of the judgment in Dr. Shekhar Sharma (supra).

Prayer being innocuous is not opposed.

Accordingly, this petition is disposed of with direction to respondent No.2 to consider and decide the cases of the petitioners strictly in terms of the judgment dated 21.12.2022, passed in CWPOA No. 6997 of 2020 within a period of eight weeks from today by passing a detailed and reasoned order. It is further directed that in case the petitioner is found similarly situated to the petitioner in CWPOA No. 6997 of 2020, the petitioner will also be granted all the benefits, as have been granted to the petitioner in the aforesaid petition i.e. CWPOA No. 6997 of 2020.

The petition is disposed of. Pending applications, if any, also stand disposed of.
