Pursuant to the order passed by this Hon’ble Court dated 21.05.2025, Shri Sushil Kumar Sharma, retired District and Sessions Judge of Assam, has been appointed as the sole arbitrator to resolve the disputes and differences arising between the parties, subject to furnishing a written declaration as prescribed under Section 12 of the Arbitration and Conciliation Act, 1996. In compliance thereof, Shri Sushil Kumar Sharma has furnished the requisite written declaration vide communication dated 03.06.2025, wherein he has stated that he has no difficulty or disqualification in accepting the appointment and acting as the arbitrator to adjudicate the disputes and differences between the parties. In view of the foregoing, the appointment of Shri Sushil Kumar Sharma, retired District and Sessions Judge of Assam, by the earlier order dated 21.05.2025 is hereby confirmed. Shri Sushil Kumar Sharma shall act as the sole arbitrator to adjudicate the disputes and differences arising between the parties with regard to the agreement of sale deed dated 03.08.2009, which is annexed as Annexure-I to the arbitration petition. The parties are directed to appear before the sole arbitrator appointed by this Court within four (4) weeks from the date of this order. This order shall be communicated by the Registry to the sole arbitrator. The parties are also at liberty to place a copy of this order before the sole arbitrator appointed.
