The petitioner is before this Court seeking for the following reliefs: " i) Issue a writ of mandamus directing the Respondent No. 2 to issue the passport to the minor child Ishan Nikhil Agadi without the requirement of the signatures of Respondent No.3 (Annexure 'A'); - 3 - HC-KAR NC: 2025:KHC:53863 WP No. 34356 of 2025 ii) Grant any other order/s as this Hon'ble Court deems fit in the facts and circumstances of the case in the interest of justice and equity." 2. An application had been made by the petitioner - mother for issuance of a passport of the minor child Ishan Nikhil Agadi to respondent No.2, which was not processed by respondent No.2 on account of either Annexure C or Annexure D to the Passport Rules, 1980, having been produced. 3. Notice having been issued. Respondent No. 3 - father has entered appearance. Sri V. Krishnamurthy, learned counsel for respondent No.3 submits that respondent No. 3 will comply with the requirement of Annexure D and submit the necessary documents to respondent No.2 subject to petitioner complying with the visitation rights granted by this Court on 03.09.2024 in CP No.311/2024 c/w CP No.310/2024. 4. Learned counsel for the petitioner submits that the petitioner would comply with the order dated 03.09.2024 - 4 - HC-KAR NC: 2025:KHC:53863 WP No. 34356 of 2025 in CP No.311/2024 c/w CP No.310/2024. In that view of the matter, I pass the following order. ORDER (i) The writ petition is allowed. (ii) A mandamus issued directing respondent No.2 to re-issue the passport of the minor child Ishan Nikhil Agadi within 15 days of the petitioner and respondent No.3 filing necessary affidavit and/or undertaking in terms of Annexure D of the Passport Rules, 1980.
