The Applicant is in judicial custody in connection with FIR No.218 of 2024 for the offence punishable under Sections 318(4), 319(2), 204 & 61(2) of B.N.S. r/w Section 12 of Prevention and Corruption Act, 1988 registered at P.S. Rajpur, District Dehradun. 4. Heard Ms. Reema Rana, learned legal aid counsel for the Applicant and Mr. Prabhat Kandpal, learned Brief Holder for the State of Uttarakhand. 5. In the present matter the FIR was lodged on 20.09.2024 on the basis of some secret information received against the Applicant and other co-accused on the premise that certain persons in the name of CM Help Line Portal are seeking money by giving false promise. 6. Learned counsel for the Applicant submits that Applicant has no criminal history; learned counsel for the Applicant submits that the QR code belongs to the co-accused and no specific amount is mentioned in the QR code. She further submits that co-accused Shubham Anand has been granted bail by the Hon’ble Supreme Court on 17.07.2025 on such terms and conditions as may be imposed by the trial court in connection with FIR No.218 of 2024, thus on the basis of parity Applicant is also entitled to be released on bail. 7. Learned State Counsel has vehemently opposed the bail application and submits that the it is a serious crime against the society; he submits that Applicant and the co-accused are friends thus the bail application should be rejected. 8. After hearing the learned counsel for the parties, on perusal of the record and without going into the merits of the case, this Court is of the opinion the Applicant be released on bail. 9. Accordingly, the bail application is allowed. Let the Applicant-Shailendra Gusain be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of court concerned.
