ORAL ORDER Learned High Court Government Pleader takes notice for both the respondents.
2. The grievance of the petitioner is directed against the impugned endorsement at Annexure-F dated 20.02.2023 issued by the Deputy Commissioner to the petitioner stating that there are no surplus lands available in Tumkur District for being granted to the petitioner under the Ex-Serviceman quota.

Learned counsel for the petitioner submits that the State Government has issued a circular that wherever surplus lands are not available for grant in favour of Ex- servicemen, they may be allotted a residential site.

Accordingly, the writ petition stands disposed of, with a direction to the Deputy Commissioner, Tumkur District, to consider the application filed by the petitioner for grant of agricultural lands, taking into consideration the circular issued by the Government and allot a residential site accordingly, if there are no surplus lands available in the district to be allotted in favour of the petitioner. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a certified copy of this order.
Ordered accordingly.
5. Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today.
