HC-KAR NC: 2025:KHC:48072 WP No. 7590 of 2022
ORAL ORDER In this writ petition, the petitioner is assailing the letter dated 07.03.2022 (Annexure-N) issued by the respondent No.5.
2. Heard Sri.Gopalakrishnamurthy,
learned counsel appearing for the petitioner, Sri Thyagaraja.S, learned counsel appearing for respondents No.1 to 4 and Sri.Mahantesh Shettar, learned Additional Government Advocate appearing for respondent No.5.
4. It is argued by Sri.Gopalakrishnamurthy, learned counsel appearing for the petitioner that, the Respondent No.5 has issued the letter dated 07.03.2022 for transfer of the LPG Cylinder connections without issuing prior notice to the petitioner herein and same was done at the instance of the persons mentioned in Reference Nos.1 to 3 of the said letter and accordingly, sought for interference of this Court.
5. Per contra, Sri.Thyagaraja.S, learned counsel appearing for respondents No.1 to 4 submitted that, in Hosadurga Taluk earlier, only the petitioner's Gas Agency was functioning but now there are three more Gas Agencies installed and therefore,

the Respondent No.5 has issued the impugned letter at Annexure-N to the petitioner.
6. Learned AGA also sought to justify the impugned letter at Annexure N.
7. In the light of the submission made by the learned counsel appearing for the parties, it is not in dispute that, the impugned letter dated 07.03.2022 at Annexure-N has been issued without providing oral hearing to the petitioner herein. Hence, I am of the view that, the Letter dated 07.03.2022 issued by respondent No.5 to the petitioner may be considered as a Show Cause Notice to the petitioner herein and the petitioner be permitted to file reply to the aforesaid Letter (Annexure-N) within a period of 4 (four) weeks from the date of receipt of this Order and thereafter, the respondent No.5 shall take decision in the matter in accordance with law. With the aforesaid observation, the writ petition is disposed of. SD/- (E.S.INDIRESH) JUDGE
