Applicant- Aditya Yadav has filed this application under Section 447 Bhartiya Nagrik Suraksha Sanhita, 2023 seeking transfer the proceeding of Case No.288 of 2024, titled Sonal Yadav and another Vs. Aditya Yadav, under Section 125 Code of Criminal Procedure, from the court of Principal Judge, Family Court, Sambhal at Chandausi to some other court of competent jurisdiction. Learned counsel for applicant has argued that the father of complainant-opposite party no.2 is a practicing advocate in district Sambhal at Chandausi where the subject case is pending, and he further submits that the applicant was threatened by the opposite side. Learned counsel prays that it would be in the interest of justice, if, the subject case is transferred from Sambhal to any other district. After hearing the learned counsel for applicant and considering his submissions, this Court does not find any merit in the application and merely because the father of opposite party no.2 is a practicing advocate, this alone is not a ground to transfer of the case. Similarly, the ground relating to threat to the applicant is also vague and without particulars. The application is dismissed.
