JUSTICE MOHAMMAD NAWAZ ORAL ORDER Heard the learned counsel for petitioners, learned High Court Government Pleader for the State and perused the material on record. 2. FIR in Crime No.173/2025 of Hassan Extension Police Station, Hassan is registered against accused Nos.1 to 4 for the offence punishable under Section 126(1), - 3 - HC-KAR NC: 2025:KHC:35722 CRL.P No. 11842 of 2025 115(2), 352, 109, 3(5) of BNS, 2023. Petitioners are arraigned as accused Nos.1 to 3 respectively in the FIR. 3. It is alleged that on 11.07.2025 at about 11:30 a.m., when the complainant/injured was drinking tea along with his friend, Shekhar @ Prajwal, in a canteen situated near Canara Bank Cross, K.R.Puram, Hassan, accused came in two motorcycles, demanded him to buy a cigarette for them and when he refused, abused and assaulted him with a repiece patti on his head, back and hands etc. 4. A perusal of the complaint averments goes to show that the accused and the complainant are strangers. The incident took place on account of a petty quarrel. The accused were not armed when came to the spot. They are alleged to have picked a repiece patti and stone which were at the spot and assaulted the complainant. As per wound certificate, the injuries sustained by the complainant are simple in nature. No criminal antecedents against the petitioners are brought to the notice of the - 4 - HC-KAR NC: 2025:KHC:35722 CRL.P No. 11842 of 2025 court. Petitioners have undertaken to cooperate with the investigation of the case and furnish sufficient surety to ensure their presence before the court. Accordingly, the following: ORDER i. Petition is allowed. ii. Petitioners/accused Nos.1 to 3 in Crime No. 173/2025 of Hassan Extension Police Station, Hassan, shall be released in the event of their arrest, subject to following conditions: a) They shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for the likesum and shall cooperate with the investigation. b) They shall furnish proof of their address/contact number and shall inform - 5 - HC-KAR NC: 2025:KHC:35722 CRL.P No. 11842 of 2025 the I.O in case of any change in the address/contact number. c) They shall not tamper with the prosecution evidence/witnesses either directly or indirectly. d) They shall be regular in attending the Court proceedings.
