1. Heard Mr. D.Borah, learned counsel for the petitioner Bishajit Saikia who has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail since he is behind the bars since 05.01.2025 in connection with Majuli Police Station Case No. 01/ 2025 ( GR Case No. 02/2025) under Sections 103(1) of the Bharatiya Nyaya Sanhita, 2023.

2. Heard learned Additional Public Prosecutor Mr. D.P. Goswami for the respondent State.
3. The allegation against the petitioner is that the petitioner along with the deceased and other co-accused named in the FIR went out for a picnic but the deceased Pinku Hazarika was found missing. Police search was made and finally the body was recovered from the river Brahmaputra. Investigation has progressed substantially. The merits of this case are not brought to the fore as investigation is still under progress.
4. I have considered the length of detention.
5. It appears that bail may be granted to the petitioner. Petitioner has pledged to abide by any conditions if imposed upon him.
6. Considering all the aspects, the prayer for bail is allowed.
7. The petitioner named above shall be enlarged on bail on furnishing a bail bond of Rs.20,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Majuli under the conditions that:- (i)That the petitioner shall co-operate with the investigation and shall appear before the Investigating Officer on every fortnight till completion of investigation, (ii)That the petitioner shall not leave the jurisdiction of the Court without prior permission.
8. On breach of any of the bail conditions, Court is at liberty to cancel the bail granted to the petitioner.

9. In terms of the above observations, the Bail Application stands disposed of.
