After arguing for some time, learned counsel for the petitioner seeks permission of this Court to withdraw the petition. However,
learned counsel has submitted that since the petitioner is a migrant, it will not be feasible for him to appear before the trial Magistrate due to security situation, as such, he may be exempted from personal appearance before the learned trial Magistrate.
While dismissing the instant petition as withdrawn, it is provided that in case the petitioner approaches the learned trial Magistrate for grant of exemption from personal appearance, the same shall be favourably considered by the learned trial Magistrate and unless personal appearance before the learned Magistrate is absolutely necessary, he shall be permitted to be represented through his counsel.
