1. Heard learned counsel for the petitioner and learned AGA-I for the State. Supplementary affidavit filed today is taken on record.
2. This writ petition is preferred praying for the following principal relief:
"i) issue, a writ, order or direction in the nature of certiorari quashing the impugned F.1.R. dated 20.12.2024, in Case Crime No.669 of 2024, U/S 69, 115(2), 333, 351(2), 303(2) B.N.S., Police Station Gorakhnath, District Gorakhpur (Annexure No.1 to the writ petition). ii) issue, a writ, order or direction in the nature of mandamus commanding the respondents not to arrest the Petitioner in pursuance of the impugned F.I.R. dated 20.12.2024, in Case Crime No.669 of 2024, U/S 69, 115(2), 333, 351(2), 303(2) B.N.S., Police Station Gorakhnath, District Gorakhpur."
3. After substantial argument, once the court has declined to quash the impugned first information report, learned counsel for the petitioner states that the petitioner does not want to press the writ petition and the same may be dismissed as not pressed and leave may be accorded to invoke the remedy as available in law.
4. Accordingly, the writ petition is dismissed as not pressed. Needless to say, in case the petitioner is aggrieved, he may avail the remedy as available in law. (Prashant Kumar,J.)
