JUSTICE MANASH RANJAN PATHAK ORDER 24.03.2025 Heard Mr. A Khanikar, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam for the State. 2. Apprehending his arrest, the petitioner, namely, Sri Ajit Koch @ Sonmoni, son of late Dhiren Koch, resident of Sonaipam, Lokhra, Police Station-Chariduar, District-Sonitpur has filed this application on 21.02.2025 under section 482 BNSS, 2023, seeking pre arrest bail in Chariduar Police Station Case No. 08/2025 under Sections 14/15 of the Assam Game and Betting Act, 1970, corresponding to G.R. No. 52/2025. 3. The Court by order dated 25.02.2025 granted interim bail to the petitioner in said Chariduar P.S. Case No. 08/2025. 4. Mr. M P Goswami, learned APP, Assam from the case diary has submitted that on obtaining interim bail on 25.02.2025, the petitioner appeared before the concerned Investigating Officer of the case on 03.03.2025 and his statement has been recorded. 5. However, Mr. M P Goswami, learned APP, Assam from the case diary has submitted that one of the co-accused of the case is evading arrest and one arrested co-accused implicated the petitioner stating that it is he who conducted DISE game. 6. Perused the case diary placed before the Court today by Mr. M P Goswami, learned APP, Assam. 7. Considering such materials in the case diary and as the petitioner has already appeared before the concerned I.O. of the case, the Court is of the view that custodial detention of the petitioner, namely, Sri Ajit Koch @ Sonmoni, is not warranted for investigation of said Chariduar P.S. Case No. 08/2025. 8. As such, this pre-arrest bail application of the petitioner in said Chariduar P.S. Case No. 08/2025 is accepted. 9. Accordingly, the interim bail granted to the petitioner on 25.02.2025 in said Page No.# 3/3 Chariduar P.S. Case No. 08/2025 is hereby made absolute, subject to the compliance of the terms and conditions as specified in the said order dated 25.02.2025. 10. Any violation of the terms and conditions as specified in the order dated 25.02.2025, noted above, by the petitioner, the pre-arrest bail granted to him in said Chariduar P.S. Case No. 08/2025 shall stand automatically vacated. 11. This pre-arrest bail application accordingly stands disposed of. 12. Return the case diary herewith. JUDGE Comparing Assistant
