This writ petition has been filed seeking following relief :- "Issue a writ order or direction in nature of mandamus commanding the respondents to evict the respondent no. 5 to8 from the illegal encroachment upon 0.002 H of the chak marg / Arazi no. 200 Rakba 0.049 of Mauza Ramgarh, Tappa- Sikandarpur, Pargana- Chillupar, Tehsil- Gola, District- Gorakhpur under section 122 (B) Act U.P.Z.A. & L.R. Act, 1950. within stipulated period/Fixed by this Hon'ble court Other wise applicant/Petitioner will be Suffer irreparable loss and injury. B. Issue a writ order or direction in nature of mandamus commanding to the respondent no. 2 decide an application dated 23. 08. 2024 within stipulated period fixed by this Hon'ble court applicant Petitioner will be Suffer irreparable loss and injury." 3. A preliminary objection has been raised by learned Standing Counsel that petitioner is complainant and not a party to the proceedings and, therefore, prayer made by the petitioner cannot be granted. 4. In view of the same, I am not inclined to interfere in the matter. 5. In case petitioners are aggrieved by inaction on the part of respondents, they may move an application for execution of the orders passed against the private respondents. 6.
