ORAL ORDER
Petitioner, arraigned as accused No.3 in the chargesheet filed in connection with Cr.No.206/2023 of Srirangapatna Police Station, Mandya, has preferred this petition seeking bail on the ground of parity.
2. Heard learned counsel for petitioner, learned High Court Government Pleader and perused the material on record.
3. The aforementioned crime is registered on a complaint lodged by one Pramoda, against 14 named accused and others, for the offence punishable under Section 143, 148, 114, 302 r/w 149 of IPC.
4. The complainant being an eye witness to the incident, has alleged that all the accused have committed the murder of his brother Vinod on 2.10.2023 at about

5.30 am in front of Dasachar land, Near H.M.Resor, Palahalli village, Srirangapatna Taluk, Mandya, by assaulting him with lethal weapons all over his body.
5. Petitioner is not named as an accused in the FIR. In the course of investigation, statements of other eye witnesses i.e., CWs.2 to 4 were recorded. The further, statement of the complainant was also recorded. Chargesheet was filed against accused Nos.1 to 12 for the offence punishable under Section 143, 148, 114, 120B, 302 r/w 149 of IPC. Petitioner is arraigned as accused No.3 in the chargesheet. He was arrested on 6.10.2023 and in judicial custody since then.
6. As per chargesheet allegations, petitioner has assaulted the deceased with a chopper on his head. Similar allegations are made against accused Nos.2, 4 and 5, who are granted bail by this Court in Crl.P.No.9764/2025 C/w Crl.P.No.6004/2025 vide order dated 21.7.2025, Crl.P.No.6884/2025 vide order dated

7. Taking into consideration that the petitioner was not named as an accused in the FIR and the accused against whom similar overt acts are attributed are granted bail and also considering that the petitioner has no criminal antecedents and is in judicial custody since 6.10.2023, he can be enlarged on bail by imposing conditions. Hence, the following:
ORDER I. Petition is allowed. II. Petitioner/accused No.3 in S.C.No.5023/2024 pending on the file of the Court of III Additional District and Sessions Judge, Mandya (sitting at Srirangapatna) (Cr.No.206/2024 of Srirangapatna Police Station, Mandya), shall be enlarged on bail, subject to following conditions:

1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall not leave the jurisdiction of the trial Court, without prior permission of the learned Sessions Judge, until the case registered against him is disposed of.
6. He shall appear before the trial Court regularly on all dates of hearing.

Violation of condition/s shall result in cancellation of bail.
