JUSTICE RAJESH RAI K) This contempt proceeding is initiated by the complainant against the respondents under Sections 11 and 12 of the Contempt of Courts Act, 1971 for the willful disobedience of the order dated 05.02.2024 passed in W.P.No.14895/2022 by the learned Single Judge, wherein the learned Single Judge has directed in paragraph No.3 as under: - 3 - HC-KAR NC: 2025:KHC:29833-DB CCC No. 754 of 2024 "3. In the light of the submission made by the learned counsel for the petitioner, the captioned petition having been rendered infructuous stands disposed of reserving liberty to the petitioner to submit a detailed representation and make out a case as indicated in the application filed under Section 151 of CPC. If such a representation is made to the concerned authority, the same shall be dealt in accordance with law within an outer limit of three months." 2. Learned Additional Government Advocate submits that she has filed compliance affidavit dated 04.09.2024 along with endorsement issued by the Collegiate Education. 3. We have perused the affidavit and endorsement. 4. On careful perusal of the same, it is specifically stated, the benefit of salary for the period beyond 60 years upto 62 years after adjusting the pensionary amount cannot be granted to the complainant. In such circumstance, the scope of this proceeding is limited and the complainant is entitled to challenge the said endorsement, if he is aggrieved.
