For Petitioner : Mr.K.M.Subrahmaniam For R1 to R4 : Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) For R7 and R8 : Mr.R.Sudhakar O R D E R This Writ Petition (Criminal) has been filed for a direction, directing the respondents 1, 2 and 4 to give suitable police protection on the complaint dated 20.08.2025 in the event of the commission of criminal act by the respondents 7 and 8 including their henchmen. 2. Admittedly, the petitioner is cultivating tenant of the land comprised in S.No.474 to an extent of 0.51.50 ares (1 acre and 27 cents) situated at Gopalasamuthram Village, Sirkazhi Taluk, Mayiladuthurai District. The said land owned by the respondents 5 and 6 herein. The right of the petitioner as a cultivating tenant was also confirmed by the Revenue Authorities. While being so, the respondents 7 and 8 herein claiming to be the owner of the subject property through the Settlement Deed, which was allegedly executed by the respondents 5 and 6 in favour of the respondents 7 and 8 registered vide Document No.1247 of 2024, dated 28.06.2024 and they attempted to take possession of the subject property. 4. Though the respondents 7 and 8 are claiming to be the owner of the subject land by way of Settlement Deed dated 28.06.2024 registered vide Document No.1247 of 2024, admittedly the petitioner is cultivating tenant of the subject land and his right was also declared by the Revenue Authorities. That apart, the respondents 5 and 6 also filed a suit challenging the Settlement Deed dated 28.06.2024 as null and void in O.S.No.102 of 2024 on the file of the District Munsif Court, Sirkazhi and it is pending for adjudication. 3/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1208 of 2025 5. On the complaint lodged by the respondents 5 and 6, it was referred before the Revenue Divisional Officer to initiate proceedings under Section 164 of BNSS. After due enquiry, the Revenue Divisional Officer found that the Settlement Deed executed in favour of the respondents 7 and 8 is a forged one and also directed the concerned jurisdictional Tahsildar to recommend for cancellation of the document registered vide Document No.1247 of 2024 by the Registering Authority. 6. The petitioner, who is being cultivating tenant of the subject property, also filed suit in O.S.No.253 of 2024 on the file of the District Munsif Court, Sirkazhi as against the respondents 7 and 8 herein for permanent injunction and it is also pending for adjudication. 7. In view of the above, the respondents 7 and 8 shall not disturb the physical possession and enjoyment of the subject property by the petitioner as cultivating tenant during harvesting of any of the agricultural crops. 8. At the request of the petitioner, the 4th respondent is directed to conduct enquiry, after issuance of notice to the petitioner and respondents 5 to 8 herein and pass orders to provide adequate police protection to the 4/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1208 of 2025 petitioner, while harvesting the agricultural crops. It is also made clear that if any offence committed by the respondents 7 and 8 herein, the 4th respondent is directed to register FIR and proceed in accordance with law. 9. With the above direction, the Writ Petition (Criminal) is disposed of.
