Learned counsel for the petitioner has filed a memo for withdrawal of the criminal petition. Memo which is placed on record reads as under:
“The undersigned advocate for the petitioner respectfully submits that the petitioner filed the above petition seeking to quash the order dated 29-07-2021 passed by the trial Court on I.A.No.II in Crl.Misc No.266/2019. The application was filed by the petitioner seeking interim custody of the child. The trial Court allowed the petition filed by the petitioner providing interim custody of the child as sought for in the application. Hence the above petition becomes infructuous and hence the petitioner is not interested to continue in the present petition. Hence this Hon’ble Court may be pleased to take the memo on record and permit the petitioner to withdraw the petition in the interest of justice. ”
