This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers: “a) Issue a writ of mandamus directing the Respondents to immediately preserve, verify and examine: i. Answer-data of the Petitioner ii. Server/system logs iii. Submission timestamps iv. CCTV footage of the examination hall v. Incident reports/logbooks of invigilators b) Direct the Respondents to provisionally include the Petitioner in the counselling process or keep one seat reserved in the concerned speciality, subject to outcome of verification; This is a digitally signed order. Mr. Tamta, learned Senior Counsel appearing on behalf of the petitioner, states that the petitioner appeared in INI-SS CBT (Endocrinology) at Chandigarh Digital Zone, examination center Plot No. 780 Halo Manjara, Delhi Chandigarh Road, Chandigarh-160002. The scheduled time of the examination was from 10:00 AM to 11:30 AM. 3. According to the petitioner, during the examination the computer allotted to the petitioner became unresponsive and froze for approximately 2 minutes before the end of the examination and the petitioner instantly informed the same to the invigilator. The invigilator tried to reboot the computer allotted to the petitioner but could not succeed and hence the petitioner wasted valuable 2 minutes due to no fault of the petitioner resulting in the petitioner losing valuable marks. 4. The respondent has produced the relevant server logs, answer keys and the CCTV footage. I have perused the same in Court. 5. As per the server log, the petitioner started the exam on 10:01 AM. 6. CCTV footage has been played from 11:27 AM to 11:31:45 AM and it shows that the petitioner is duly using his computer to mark his response without any sign of stress/malfunctioning. 7. Whether the system of the petitioner failed or whether the petitioner was unable to take the exam are disputed questions of fact which cannot be adjudicated as a subject matter of this writ petition and, requires detailed evidence. 9. For the said reasons, the petition is disposed of along with the pending applications, with granting liberty to the petitioner to avail its legal remedies in accordance with law. 10.
