1. Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), is for grant of anticipatory bail to the petitioner, in case FIR No.188 dated 23.06.2025, under Section 69 of BNS, registered at Police Station Quilla, District Panipat.
2. Vide order dated 21.07.2025, the following passed by this Court, which is reproduced hereinafter:-
“Prayer in the present petition filed under Section 482 of BNSS, is for grant of anticipatory bail to the petitioner, in case FIR No. 188 dated 23.6.2025, under Section 69 of BNS, registered at Police Station Quilla, District Panipat.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case. In fact, the petitioner and the prosecutrix were in a consensual relationship and there was no promise of marriage from either side. It is further submitted that when on account of discord between them, the petitioner decided to call off their relationship, the prosecutrix in
order to threaten him jumped into a canal. However, she was rescued by the divers. It is further submitted that on 8.6.2025, the prosecutrix came to the house of the petitioner carrying a katta i.e. a country made pistol and threatened to kill him or herself. On the oral request of the counsel for the petitioner, complainant is impleaded as respondent No. 2 in the present petition. He undertakes to file amended memo of parties in the Registry within 07 days. Registry is directed to carry out necessary amendments in the memo of parties. Notice of motion. Ms. Saumya Ahluwalia, Sr. DAG, Haryana waives service of notice on behalf of the respondent-State and prays for time to file reply. Mr. Lajpat Rai Sharma, Advocate puts in appearance on behalf of the complainant and files his power of attorney, which is taken on record. Learned counsels for the parties submit that there are chances of amicable settlement between the parties. Accordingly, the parties are directed to appear before the Mediation & Conciliation Centre at Gurdaspur on 28.7.2025 at 11.00 A.M. for working out a possible amicable settlement. Needless to say that parties shall remain present on each & every date fixed by the said forum. For awaiting report, adjourned to 11.8.2025. In the meantime, no coercive steps be taken against the petitioner.”
3. Thereafter this Court vide order dated 11.08.2025, the petitioner was directed to join investigation. The said order is reproduced hereinafter:-
“Status report by way of affidavit of Deputy Superintendent of Police, Traffic, Panipat, has been filed by the State, which is taken on record. Copy thereof has been supplied to the learned counsel for the petitioner. As per the report received from the Mediation and Conciliation Centre of this Court, the matter has been amicably settled between the parties. In view of the above, the petitioner is directed to join investigation before the Investigating Agency/Officer. He shall abide by the following conditions as envisaged under Section 482(2) BNSS, 2023;- ANJAL GUPTA 2025.09.26 18:12 I attest to the accuracy and integrity of this document

(1) That the petitioner shall make himself available for interrogation by a police officer as and when required to do so.
(2) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts to the case so as to dissuade him from disclosing such facts to Court or to any police officer. (3) That the petitioner shall not leave India without prior permission of the Court. Needless to mention that the investigating agency/officer shall continue with the investigation of the case in usual manner Adjourned to 01.9.2025.”

Learned State counsel on instructions from the investigating officer concerned, submits that in compliance of order of this Court dated 11.08.2025, the petitioner has joined the investigation and is not required for any further investigation. 5. Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 11.08.2025 passed by this Court, is hereby made absolute. 6. This order should not be treated as "blanket" order. It will not be read granting the petitioner(s) indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 7. This order does not in any manner limit or restrict the rights or duties of the police or investigating agency to investigate into the charges against the petitioner(s). 8. The accused-petitioner(s) shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him or her from disclosing such facts to the Court or to any police officer. 9. The accused-petitioner(s) shall not leave India without prior permission of the Court. 10. The accused-petitioner(s) shall join the investigation as and when called by the police. 11.
It will be open to the police or the investigating agency to move to this Court for a direction under Section 483(3) of BNSS, 2023 (erstwhile Section 439(2) of Cr.P.C.) to arrest the accused-petitioner(s), in the event of violation of any term, such as absconding, non-cooperating during investigation, evasion, intimidation or inducement to witnesses with a view to influence outcome of the investigation or trial. 12. Pending miscellaneous application(s), if any, also stands
disposed of.
