1. Despite receipt of notice of the present revision petition, the respondent remains unrepresented. Respondent- Satyawan filed a suit for declaration to the effect that he is the exclusive owner of the plot marked by letters ABCD reflected in the layout plan with a consequential relief of permanent injunction. In the aforesaid suit defence of the petitioner (defendant) has been struck off for failure to file written statement within the period prescribed under the Code of Civil Procedure, 1908.

Learned counsel representing the petitioner submits that the suit property has been purchased by the petitioner (defendant) vide sale deed dated 21.09.2023 from the plaintiff (Satyawan).
3. Keeping in view the aforesaid facts, prima facie the suit is rendered infructuous, however, the respondent is not represented before this Court. Hence, in the peculiar facts of the case, the revision petition is
disposed of while setting aside the impugned order dated 12.12.2023 while granting liberty to the petitioner to file his written statement and Rekha Sihag 2025.05.13 02:15 I attest to the accuracy and integrity of this document Chandigarh
CR-4832-2024(O&M) 2 also an application for disposal of the suit as infructuous in view of the subsequent sale deed. If such an application is filed, the same shall be decided by the court within a period of one month, thereafter.
