This writ petition has been filed for a direction upon the respondents to release the admitted dues of the petitioner for work performed by the petitioner under the Contract Bond No. 01/SE/2013-14, dated 30.4.2013, for construction of Quinet - A for reducing the pressure of River Ram Ganga. Petitioner has relied upon a certificate issued by the Executive Engineer, dated 30th January, 2016, according to which, a sum of Rs. 2335354.00 is admittedly due and payable to the petitioner. Although a counter affidavit has been filed disputing the petitioner's claim, but we find that there is no conscious application of mind on part of the concerned authority with regard to payment to be released to the petitioner. Various documents acknowledging the petitioner's right to receive admitted dues have otherwise not been disputed. In such circumstances, we are of the view that ends of justice would be met if a direction is issued upon the respondent no. 4 to examine the issue and to take an appropriate decision with regard to release of alleged admitted dues of the petitioner. Since there is no adjudication so far in the matter by the respondents, all factual issues with regard to claim of the petitioner are left upon for determination by the authority concerned. Such decision shall be taken within a period of two months, from the date of presentation of a certified copy of this order. In the event the claim of the petitioner is accepted, the authorities will also accord consideration to petitioner's claim for payment of interest in terms of the contract/applicable government order.
