Rattu, DAG, Punjab. *** SANDEEP MOUDGIL, J.(Oral) This Criminal Writ Petition under Article 226 for issuance of writ in the nature of mandamus for issuance of direction to official respondents to protect the life and liberty of the petitioners and to restrain the private respondents not to harass the petitioners. Learned State Counsel has submitted that a speaking order has already been passed in the complaint dated 17.07.2025 (Annexure P-3) by the authorities concerned and has produced the copy of the same, which is taken on record. He has furnished a copy of the order to counsel for the petitioners. The relevant part of the speaking order is reproduced below :- Anuradha 2025.07.23 22:58 I agree to specified portions of this document CRWP-7911-2025 (O&M) 2 ‘Whereas Arshdeep singh aged 23 years s/o Balwant Singh R/o Village Pale chak(megha Mahatam) Police station Guruharsahai and Pawandeep kaur aged 17 years 08 months d/o Narinder singh r/o Ward no 07, Talwandi Bhai District Ferozepur, now living in relation with Arshdeep singh s/o Balwant Singh R/o Village Pale chak(megha Mahatam) Police station Guruharsahai, had moved a complaint before the Senior Superintendent of Police, Ferozepur alleging threat perception from the family members of Pawandeep kaur. The complainants have mentioned in their complaint that Arshdeep singh is major and Pawandeep kaur is minor and they both are living happily in relation against the wishes of parents of girl namely Pawandeep kaur and now they are apprehending danger to their lives at the hands of family members of girls and have demanded protection of their life and liberty. During enquiry, undersigned i.e. SHO, PS: Guruharsahai, District Ferozepur, have confirmed from SHO PS Talwandi Bhai where he stated that no case have been registered against Arshdeep singh. Moreover SHO PS Guruharsahai along with his team visited village Pale chak( Megha Mahatam) i.e. present address where both of them are residing and both the complainants were not found present at the given address in the complaint and no other family member were present at home. However the undersigned approched sarpanch Jagsir singh s/o malook singh and said Jagsir Singh to inform immediately to the Police of PS: Guruharsahai, District Ferozepur as and when the complainants or their family member came back to the aforesaid address given in the complaint or if they would found any contact number of complainants. However in future, if the complainants approached the Police Department with the request to obtain any kind of protection through any written complaint or Jawithout any kind of delay. Further the patrolling party of the area of representation, then the same will be provided to them immediately, complainants, also directed by the undersigned to Anuradha 2025.07.23 22:58 I agree to specified portions of this document CRWP-7911-2025 (O&M) 3 keep vigilant in view of the seriousness of the matter. Keeping in view the above mentioned facts and circumstances, at this stage no protection can be provided to the complainants as they were not found present at the given address in the complaint.’ In light of the above, counsel for the petitioner does not wish to press this petition further. The petitioners would be at liberty to file appeal, as is stipulated in the Standard Operating Procedure, in the light of notification No.HOMEHM-40 40SECM/14/2025-2H4/63 dated 23.01.2025 issued by the Department of Home Affairs, Punjab, Government of Punjab (Home-4 Branch)., in case of any grievance left after passing of the speaking order. Petition stands dismissed as not pressed.
