JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 27.02.2025 This is a common order for these two bail applications as both the bail applications have arisen out of the same FIR. 2. Heard Mr. NJ Dutta as well as Mr. A.K. Saikia, the learned counsel appearing for the petitioners and Mr. K K Das, the learned Additional Public Prosecutor appearing for the State of Assam. 3. Both the bail applications are filed under Section 483 & 482 of BNSS, 2023 praying for releasing the petitioners on bail as well as for grant of pre-arrest bail in respect of Bilasipara P. S. Case No. 8/2025. 4. Police found one death certificate in respect of Jabed Ali Sheikh. The embedded QR Code was found to be a fake one. It is alleged that the relatives of the said Jabed Ali Sheikh had procured the false death certificate for utilising it for their own benefit. 5. The petitioner Mintu Ray @ Moon Ray has stated that he owns a computer shop, where many people come for print out, Photostat etc. online. His neighbour Biki Sarma originally from Bihar, requested the petitioner Mintu Ray @ Moon Ray that he wanted to open a CSC Centre at Bihar. The petitioner accordingly carried out all the requirements through his computer. 6. The other petitioner Saleh Uddin has stated that he has no connection with the aforesaid allegation. He also has a shop. He is doing the business of issuing Pan Card. 7. I have considered the submissions made by the learned counsel of both sides. Page No.# 3/3 8. CD reveals that the petitioner Mintu Ray @ Moon Ray has confessed his guilt. 9. CD further reveals that many documents suspected to be forged were recovered from the house of the other petitioner. 10. The investigation is going on. Allowing the bail applications will hamper the investigation of this case. Therefore, at this stage, both the applications are found to be devoid of merit and stands dismissed accordingly.
