DISTRICT AND SESSIONS JUDGE, AT MYSURU, WHERE THE APPELLANT COURT HAS CONFIRMED THE ORDER OF CONVICTION AND ACQUIT THE PETITIONER FOR THE OFFENCE P/U/S.138 OF NEGOTIABLE INSTRUMENT ACT AND ETC., THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER The learned Counsel appearing for the petitioner and the learned Counsel appearing for the respondent are present and the respective parties are also present. 2. Heard the learned counsel appearing for the respective parties. 3 3. After negotiations, parties have arrived at settlement. Accordingly, both parties have filed Joint Memo duly signed before Lok Adalath. Joint Memo reads as follows: JOINT MEMO The Petitioner and Respondent in the above most respectfully submits as follows: 1. The Petitioner and Respondent above named submits that during the pendency of the above petition have come in to an amicable settlement and as per the said settlement, the petitioner has agreed to pay a sum of Rs.1,90,000/- (Rupees One Lakhs Ninety Thousand Only) as a full and final settlement instead of the total cheque amount of Rs.2,40,000/- (Rupees Two Lakhs Forty Thousand Only). 2. It is submitted that both the parties have agreed to settle the aforesaid amount in the following terms and conditions: a. Rs.1,22,500/- (Rupees One Lakhs Twenty Two Thousand Five Hundred Only) has already been deposited before the IV Addl. Civil Judge and JMFC at Mysuru in CC.No.529/2020 and the petitioner has no objection for the release of the said amount in favour of the Respondent. b. Rs.67,500/- (Rupees Sixty Seven Thousand Five Hundred Only) by way of account transfer to the Respondent’s account in ICICI Bank, Account No.015201560035, IFSC Code- ICIC0000152, Kalidasa Road, Mysuru, on or before 30.12.2025. 3. That in view of the aforesaid settlement, the respondent hereby confirms that there are no further claims against the petitioner. 4 4. In view of the compromise entered between the parties, this criminal revision petition is closed and the petitioner is acquitted for the offence punishable under Section 138 of N.I. Act. 5. The learned counsel for the petitioner submits that fine amount is already deposited before the concerned Court. The said submission is taken on record. Sd/- JUDGE Sd/- MEMBER SRK
