1. This matter is taken up through hybrid arrangement.
2. The Petitioners have filed this Writ Petition challenging the order dated 17.10.2025 passed by the ROC-cum- Official Liquidator, Cuttack under Annexure-1.
3. Heard.
4. Learned counsel for the Petitioners submits that as per Section 454(4) of the Companies Act, 2013, the Petitioners should have been given a personal hearing which is contemplated on the said Section.
5. Even if it is perceived to be soaked, the Petitioners could have approached the appellate authority, instead
they have invoked the extra ordinary jurisdiction under Article 226 of this Court. When there is availability of forum nearer to the Court, still the Petitioners have chosen this Court.
6. Considering the facts and submissions made, this Court is of the view that let the Petitioners approach the appellate forum by filing an appeal and raise the issue set out in the present Writ Petition at the earliest possible.
7. It is directed that if there is any delay in filing the said appeal, the same may be condoned liberally.
8. Accordingly, the Writ Petition is disposed of.
