DIRECT THE R-2 TO FACILITATE THE OFFICE OF THE SUB-REGISTRAR BY SUPPLYING NECESSARY REVUE DOCUMENTS IN ORDER TO AVOID THE PROBLEM IN REGISTERING THE LAND.

ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs;
1. Direct the R-3, to register the land in sy.no. 70 of the Emmedhoddi village, Biruru hobli, measuring 0-32 and 2-28 acres in 3-10 acres in the name of the petitioner as per the order dtd. 17.03.2022 passed in execution case bearing no. 42/2020 produced as Annx- G.
2. Direct the R-2 to facilitate the office of the sub- registrar by supplying necessary revue documents in
order to avoid the problem in registering the land.
3. Grand such other further reliefs as this Hon'ble authority deems fit to grant under the circumstance of the case, in the interest of justice.
2. The grievance of the petitioner is that in furtherance of a compromise decree in O.S. No.111/2020 in the execution proceedings filed, though a direction had been issued to register the sale deed, respondent No.3 has not registered the same on account of non- submission of the 11-E sketch.

Learned counsel for the petitioner submits that since a compromise decree has been passed by a court, there would be no requirement for production of a 11-E sketch.
4. This Court in several matters has categorically held that only in contested matters, 11-E sketch could be exempted on a case to case basis, but insofar as compromise decrees are passed, 11-E sketch would have to be produced at the time of registration.
5. In that view of the matter, reserving liberty to the petitioner to approach the Sub-registrar after obtaining a 11-E sketch, the petition stands disposed. Needless to say, if such a 11-E sketch is produced by the petitioner, Respondent No. 3 is required to register the concerned documents.
