1. The present petition under Section 24 read with Section 151 of the Civil Procedure Code, 1908 has been filed by the petitioner/wife seeking transfer of two cases i.e case No. HMGA/26/2022 titled as ‘Monu Kaushik vs. Mamta’ filed by respondent/husband under Section 25 of the Guardian and Wards Act, 1890 read with Section 6 of the Hindu Minority and Guardianship Act, 1956 and case No. HMA-271-2021 titled as ‘Mamta vs. Monu Kaushik and another’ under Sectin 13 (1)(i) & 13(1) (ii) of the Hindu Marriage Act, 1955 for dissolution of marriage by way of decree of divorce, pending in the Court of Principal Judge, Family Court, Jind to the court of competent jurisdiction at District Kurukshetra.

2. As per office report, copy of newspaper in which publication notice was issued to respondent No.2 has been placed on record in compliance of order dated 07.07.2026. However, respondent No.2 still remains unrepresented. Hence, service is complete.

Learned counsel for the petitioner submits that petitioner after having matrimonial dispute with respondent/husband is staying with her aged parents at Kurukshetra and she has no independent source of income. He further submits that petitioner is also taking care of her minor son aged 6 years and distance between Kurukshetra and Jind is 110 kms and every time petitioner has to leave her minor son and travel alongwith her aged father to Jind to attend the court hearings in the aforesaid cases.
4. Per contra, learned counsel for respondent No.1-husband opposes the present petition.

6. In view of the aforesaid facts, the present transfer application is allowed. It is directed that the proceedings in two cases i.e case No. HMGA/26/2022 titled as ‘Monu Kaushik vs. Mamta’ filed by respondent/husband under Section 25 of the Guardian and Wards Act, 1890 read with Section 6 of the Hindu Minority and Guardianship Act, 1956 and case No. HMA-271-2021 titled as ‘Mamta vs. Monu Kaushik and another’ under Section 13 (1)(i) & 13(1) (ii) of the Hindu Marriage Act, 1955 for dissolution of marriage by way of decree of divorce, pending in the Court of Principal Judge, REKHA SIHAG 2026.07.17 16:43 I attest to the accuracy and authenticity of this document Chandigarh
TA-1514-2025 (O&M) 3 Family Court, Jind be transferred to the Court of competent jurisdiction at Kurukshetra. The transferor court is directed to remit the files of the cases to the transferee court forthwith. The parties through their counsel are directed to appear before the Principal Judge, Family Court, Kurukshetra, on 03.08.2026, who would either try the case himself or assign the same to the court of competent jurisdiction in the District.
